Lauritz.com terms of purchase
These terms apply to the purchase of items and services on www.lauritz.com and other sites from Lauritz.com A/S, Dynamovej 11C, 2860 Søborg, CVR 24994570.
Registering as a customer
In order to purchase items and services from Lauritz.com, you must create a customer profile, and read and agree to our purchase and sales conditions and privacy policy.
Valuation, description and price
Valuation and pricing are based on our experience of selling the same type of item, current market trends and the seller's expectations of the sale. Valuation is not an exact science, but an indication. In the end, it is always the buyers who determine the market price, and it fluctuates. This means that some sales will be higher or lower than the valuation.
We only include items and services that have been described, valued/priced by our own staff.
As a rule, all items are sold as quality second-hand or equivalent. Therefore, normal expected age and usage-related wear as well as odours due to e.g. a smoker's home are not described. If an item has defects, faults or shortcomings, other than expected usage-related wear, we will try to describe or photograph it.
Agreement and bidding
You are responsible for all bids placed under your customer number and password. Bidding is anonymous, but your customer number will be visible once you have placed a bid. Everything is sold at the highest bid, regardless of the valuation. If a starting bid has been agreed upon for an item/service, it will be stated in the auction. If you receive a knockdown price for an item/service, you will receive an email and the purchase agreement is considered concluded. The seller may not bid on their own items. It is also not allowed to bid on an item where you have previously exercised your right of withdrawal. We reserve the right to delete bids if we deem that the bidding is not in accordance with our guidelines.
Buy now
'Buy now' means you buy the item at a fixed price. Payment must be made within 15 minutes. The item will be reserved during this period. If the payment is not completed within 15 minutes, the item will be released for sale again.
Right of withdrawal
If you are buying as a consumer, you have the right of withdrawal under the Consumer Contract Act. Read more about the right of withdrawal at the end of this document.
Premium and buyer's fee
For each lot number purchased at auction, a buyer's premium of a maximum of 25% of the sale price including VAT will be added, as well as a buyer's fee of DKK 110/EUR 15 (in the case of former lease cars, however, DKK 600/EUR 80). In certain product categories, the buyer's premium and the buyer's fee are lower. The exact premium and buyer's fee are always shown before the purchase and on the invoice, click here to see all rates. With 'Buy now' no buyer's premium or buyer's fee is charged.
VAT
The item’s description will state whether the item is sold under the general VAT rules or under the second-hand VAT scheme. The price you pay is the same whether the item is sold under the normal VAT rules or under the second-hand VAT scheme.
For items sold under the normal VAT rules, VAT will be calculated on both purchases, premiums and fees.
If you are a VAT-registered business and you buy an item that is sold under the normal VAT rules, you can deduct VAT under the normal VAT rules.
For cross-border trade, VAT is also calculated according to the above rules. If you wish to claim a VAT refund, you should contact the local tax authorities in the country where you purchased the item. Be aware of customs and import VAT rules for items crossing EU borders or items traded between two countries, both outside the EU. Lauritz.com acts as an intermediary in certain cases. This is always the case for package tours. If Lauritz.com acts as an intermediary, the only difference for you as a customer is that you must contact the auction house to which the inquiry relates, if you want an invoice with itemised VAT in connection with the purchase of a VAT item.
Resale royalty
According to Article 38 of the Danish Copyright Act, all Danish Lauritz.com auction houses are required to charge a resale royalty on behalf of VISDA for the sale of works by all Danish and certain foreign artists who are either alive or have not been dead for more than 70 years, if the sale price (including premium and fee, excluding VAT) exceeds EUR 300. If a resale royalty is to be paid, it is marked with 'CD' in the product description.
The resale royalty is calculated as:
1) 5% of the part of the sale price up to EUR 50.000,
2) 3% of the part of the sale price between EUR 50.000,01 and 200. 000,
3) 1% of the part of the sale price between EUR 200,000.01 and EUR 350,000,
4) 0.5% of the part of the sale price between EUR 350,000.01 and EUR 500,000, and
5) 0.25% of the part of the sale price above EUR 500,000.
Payment
Upon knockdown, Lauritz.com offers two payment solutions. 1) Online payment: The purchased item is paid within 3 days via 'My page' - 'Payments'. If payment is not made within 3 days, you will be charged a reminder fee and your Lauritz.com account will be closed to further purchases and sales.
2) Lauritz.com Easypay: Payment is automatic once you have registered a fixed payment method and signed up for our Easypay solution.
Registration of fixed payment method: If you choose to register a fixed payment method, your payment information will automatically be stored with PCI-certified payment provider AltaPay. All information sent back and forth between Lauritz.com and AltaPay is sent encrypted (SSL encrypted). The following applies to fixed payment method registration:
- Fixed payment method is registered on 'My Page' under 'Basic Information’.
- The name of your customer profile and the name of your payment method (payment card) must be identical.
- You can register several payment methods on your profile, but one payment method must be your primary method.
- Your primary payment method can be changed at any time on 'My page' under your 'Basic information'.
Regardless of whether you pay via online banking or via Easypay, you will always receive a confirmation e-mail as a receipt with the invoice and information about pick-up, postage, transport, etc. Read more about specific payment options at www.lauritz.com under 'Purchase' - 'Payment'.
Please note that there are special rules for the purchase and payment of package tours and cruises in connection with the issue of a travel guarantee certificate. Find out more at www.lauritz.com under 'Buying' - 'Buying package tours and cruises'.
For 'Buy now', payment must be made online within 15 minutes. Lauritz.com is not liable for any delays in payment that cause the payment deadline to be exceeded.
Collection and delivery
A purchased item can be collected at the relevant Lauritz.com auction house during opening hours immediately after purchase. In some cases, collection must take place elsewhere. See the item description for a possible change of pick-up address.
Commodities must be collected no later than the 3rd day after purchase. As the buyer, you only acquire ownership of the item when the purchase price, including costs, has been paid in full.
As a Lauritz.com customer, you have several pick-up, or delivery options.
1) You can choose to have smaller items that meet certain size and weight requirements sent to you by post. Read more about the size and weight requirements at www.lauritz.com under 'Delivery'. The payment process will also indicate if the item can be sent to you by post. Your item will be sent to you once we have received your payment. You will then receive the item within 4-5 days.
2) You can choose to have larger items shipped using the carriers listed with quotes on our website.
3) You can choose to collect the item yourself or authorise someone else to do so on your behalf, including a carrier other than our regular transport partner (Transportbyrån).
If the item is collected by you, remember to bring your receipt and photo ID (passport or driving licence). If you are sending someone else on your behalf, they must bring a copy of your ID and a written power of attorney in addition to the purchase receipt and their own ID.
If you choose options 1 and 2, the risk of damage to the item passes to you when the item is delivered. If you choose option 3, the risk of the item is transferred to you upon hand-over from Lauritz.com.
Uncollected items are subject to an external storage and handling fee of DKK 200 or EUR 27 including VAT per commenced week.
For the purchase of certain weapons, we will only hand over the item when you present a firearms licence. Your firearms licence is unique to the firearm in question and to you personally. Weapons may therefore not be collected by third parties unless an authorised carrier is involved. No storage fee is charged for the period it takes to obtain this authorisation (typically 1-3 weeks).
Please note that the choice of the delivery solution has an impact on the refund of delivery costs in case of cancellation. Read more under 'Right of withdrawal'.
Resale
If the purchase price including costs is not paid according to our terms, the item will be put up for sale again and your customer profile at Lauritz.com will be closed for buying and selling. If the purchase price is paid but the item is not collected in time, we are entitled, after sending a reminder, to put the item up for sale again in your name and at your expense. You are liable for any storage costs incurred and for any loss arising from the breach. Lauritz.com is entitled at any time to offset losses or other receivables against the net proceeds from the sale of other items belonging to you.
Cancellation of an auction/sale and technical reservations
If an auction/sale is in progress, the items/services cannot be withdrawn. However, we reserve the right to stop an auction/sale, extend the auction/sale or reschedule the auction/sale if we deem it appropriate, e.g. due to suspected abuse, errors, technical issues or reasonable doubt as to ownership. We are not responsible for delays, service disruptions or technical/internet problems of any kind, even if caused by Lauritz.com computers or technical issues.
Defects and complaints
The Sale of Goods Act's rules on deficiencies may apply. Should it be recognised after the purchase that the description of the item has contained significant errors or defects, or that the item has been in a significantly worse condition than assumed, you will be entitled to cancel the purchase or possibly receive a proportional reduction in the price. You will be refunded the total purchase amount or a smaller amount after a reasonable valuation. In the event of cancellation, the buyer shall not be entitled to claim interest on the purchase price, nor shall they be entitled to claim any other costs or losses, including any loss of resale profit.
The right to cancel a purchase can only be exercised by the person who purchased the item from Lauritz.com and is conditional on the cancellation claim being made within 2 years of the date of purchase for Denmark and Belgium, and on the purchased item being returned to the local auction house where the item was purchased within the same period. The complaint must be in writing. In some cases, it is necessary to return the item for the complaint to be processed. If the complaint is about authenticity, we ask you to provide written expertise from an independent and recognised capacity.
A purchase cannot be claimed to be cancelled under the above provisions if:
- The description of the item on the day of the knockdown/purchase was in accordance with the opinion of scholars and experts at that time.
- The only way to establish a forgery at the time of sale was to undertake scientific processes whose validity was only recognised after the time of sale, or which would have been disproportionately costly or impracticable without damaging the item in question.
In addition to the above deadlines, the general limitation rules in the Limitation Act apply, according to which the buyer can under no circumstances assert any claim against Lauritz.com when more than 5 years have elapsed from the date of purchase.
Condition report
We offer to prepare a condition report to further detail the condition of an item and any damage, if the valuation is over DKK 5,000, EUR 650.
Personal data - your information
As a customer of Lauritz.com, it is important and your own responsibility to ensure that your personal details are correct and complete, for example, that your email address or bank account information is correct. You can always make corrections under 'My page' - 'Basic information’. If your details are not provided correctly, we may choose to close your account without notice. Should this happen to you, you can contact the Lauritz auction house to which the inquiry relates, to update your details and reopen your account if necessary. Amendments to the terms
We may change these terms at any time. You will be notified of changes at the next log-in, where you will be asked to accept the changes before continuing.
Complaints
If you wish to complain about an item or service purchased from Lauritz.com, you must do so by contacting the auction house where the item was purchased. Should you need further assistance, you can also write to info@lauritz.com

ODR (Online Dispute Resolution)Finally, you can direct your complaint to ODR. ODR stands for online dispute resolution. This digital online solution is aimed at all EU consumers who shop online in other EU countries and at all European online businesses. You can contact the ODR via this http://ec.europa.eu/odr.
Applicable law and disputes
Unless otherwise provided by law, which may not be derogated from by agreement, disputes between Lauritz.com and the Buyer shall be governed by Danish law and shall be settled by The City Court of Copenhagen in accordance with the Administration of Justice Act, including the rules on appeal. In consumer contract cases, the Administration of Justice Act’s rules of jurisdiction apply.
Right of withdrawal
You have the right to withdraw from the purchase contract without giving any reason within 14 days. The withdrawal period starts at the earliest when you have received information about the right of withdrawal and information about where to exercise the right of withdrawal. Therefore, you are informed about your right of withdrawal when you register as a customer and upon bidding/knockdown/purchasing. You can also read about your right of withdrawal at www.lauritz.com.
The withdrawal period expires 14 days after the day on which you or a third party specified by you takes physical possession of the item. If you collect/receive an item on Monday 1st of a month, you have until Monday 15th of the same month. If the deadline falls on a public holiday, Saturday, bank holiday, Christmas Eve or New Year's Eve, you can wait until the following working day of the same month.
Exercising the right of withdrawal
To exercise the right of withdrawal, you must notify the auction house where you bought the item of your decision to withdraw before the end of the withdrawal period. You can do this either by letter or e-mail.
In the case of knockdown, you will receive a standard withdrawal form in the knockdown email, which you are welcome to use. For 'Buy now', you will receive a withdrawal form in the payment receipt. You may send any other unambiguous notice of your wish to withdraw directly to the auction house concerned.
Returns
In the case of a physical item, you must return or deliver it to the Lauritz.com auction house where you purchased your item, without undue delay and no later than 14 days from the date on which you informed us of the exercise of your right of withdrawal. It is sufficient that you have handed over the item to the postal service or another carrier undertaking the return delivery before the deadline. As proof that the item has been returned on time, you can keep the receipt showing that the item has been handed over to the postal service or another carrier for dispatch.
You are responsible for the direct costs related to returning the item. The expenditure is expected to be no more than the cost of delivery.
Consequences of withdrawal
If you withdraw from an item you have purchased from Lauritz.com, you will be refunded the full purchase price. This without undue delay and in any event no later than 14 days from the date on which we receive notice of your decision to withdraw from this Agreement. We may withhold the refund until we have received the item or you have provided proof that you have returned the item, whichever comes first. As a result of the EU Consumer Rights Directive introduced on 13 June 2014, the buyer can return an item during the withdrawal period, even if the item has been used. However, this will lead to a reduction in the value of the item. As a buyer, you will be charged for this depreciation in the event of withdrawal. It is the auction house that determines the depreciation value.
The choice of a delivery solution affects whether you get reimbursed for delivery costs
As a Lauritz.com customer, you have several options when choosing a delivery solution.
1) You can choose to have smaller items that meet certain size and weight requirements sent by post.
2) You can choose to have larger items sent by using the carriers listed with price quotes on our website.
3) You can choose to collect the item yourself or authorise someone else to do so on your behalf, including carriers other than our regular transport partner (Transportbyrån).
Delivery costs for a returned item are only refunded when you have the item delivered by post or with our regular transport partner (Transportbyrån) and use the same company for the return. Please also note that it is at all times your responsibility to pay the return freight from you to Lauritz.com in the event of cancellation.
Any charges you may have incurred when paying by credit card over the internet or by bank transfer will not be refunded.
Exceptions to the right of withdrawal
The right of withdrawal does not apply to professional traders (when the transaction is carried out in the course of professional activity).
The right of withdrawal also does not apply to a seller who has bid on his own item or to persons from the seller's household. The seller and the seller's close relations are already familiar with the item and therefore do not need the protection afforded by the right of withdrawal to bidders who do not have prior knowledge of the specific item.
There is no right of withdrawal for recreational leisure activities, such as cultural events, trips or experiences, if the activity specifies the day or period during which the service is to be provided.
Abuse of the right of withdrawal
Lauritz.com must ensure that all auctions/sales are conducted ethically and that buyers at Lauritz.com can place bids in the confidence that the other bids placed at an auction are genuine. We cannot, therefore, continue to deal with customers who repeatedly exercise the right of withdrawal in such a way as to create a pattern indicating that there was no genuine intention to stand by the offers made.
Lauritz.com assesses specifically in each case whether a customer's bidding pattern is consistent with the objective described above. If we observe behaviour that constitutes an abuse of the right of withdrawal, a warning will be sent stating that if this is repeated, we will choose to terminate the customer relationship and deactivate the customer's account with Lauritz.com.

Lauritz.com's conditions of sale
The following conditions apply to the sale of goods and services on www.lauritz.com. The agreement entered into is between you and Lauritz.com A/S, Dynamovej 11C, 2860 Søborg, Denmark. Danish Central Business Register No. (CVR No.) 24994570.
Registering as a customer To be able to sell goods and services at Lauritz.com, you must create a customer account, read and conform our conditions of purchase and sale as well as our privacy policy. You also need to provide your bank account details to receive payment for your sale.
Criteria, valuation and description of items We only accept lawful goods and services of good quality, and where the sales price is expected to be a minimum of DKK/SEK 800, EUR 100, however for Stamps, Coins, notes and bars DKK/SEK 350/EUR 47. Lauritz.com bases its estimates of an item on the previous sales of the same type of items, current market trends as well as the seller's expectations of the sale. Providing estimates is not an exact science but an indication. Ultimately, the market price is dictated by the buyers, and this price fluctuates. This means that some hammer prices will be higher or lower than the given estimate. On consignment, you must provide us with all the information you have about the item or service and when the auction starts you need to make sure that the lot description is correct. If this is not the case you must inform us in writing immediately. You are required to provide us with a photo ID (passport or driver's license) when consigning an item. If someone else is delivering your item on your behalf, in addition to their ID they are required to bring a copy of your ID and a written statement authorizing you to serve as proxy on their behalf.
Seller's commission and seller's fee at auctions Our seller's commission is a maximum of 15% of the knockdown price including VAT for each item sold. For each sold lot number, a maximum of DKK 200/EUR 27 is charged as a seller's fee (DKK 600/EUR 80 for Former leasing cars). In some product categories the seller's fee is lower, click here to see all rates. The seller's commission and seller's fee cover the costs of registration, valuation, description, photography, display and storage during the sale period.
Commission and fees for 'Buy now' The ‘Buy now’ price, as indicated on www.lauritz.com, includes an amount equal to the buyer's premium (25%) and the buyer's fee (DKK 110/EUR 15), which will be deducted when you are settled. Our seller's commission is a maximum of 15% of the 'Buy now' price including VAT less deducted the buyer's premium and buyer's fee. For each lot number sold, a maximum of DKK 200/EUR 27 is charged a seller's fee (DKK 600/EUR 80 for Former leasing cars). In some product categories, the seller's fee and buyer's premium are lower, click here to see all rates. The seller's commission and seller's fee cover the costs of registration, valuation, description, photography, display and storage during the sale period.
Fees and charges as well as the costs of the payment transfers are deducted from your payment. Payments are made to the account number you have provided with your customer number. Payment is made up to approximately 60 business days after the sale, provided both you and the buyer have fulfilled your obligations.
Buyer's right of withdrawal If the buyer does not complete the purchase or exercises their cancellation right the lot is put back on sale in your name and without prior notice. We reserve the right to set the lot for sale until it is sold. Under the EU Consumer Rights Directive, which entered into force 13 June 2014, the buyer can return an item during the cancellation period also if the item has been used. You as seller bear any loss in connection with this type of situation.
Unsold items If the item/services are not sold, you do not pay either the seller's commission or seller's fee. Unless otherwise agreed, Lauritz.com has the right to put the item back on sale without prior notice. If the item remains unsold after 5 times at auction, it will be put up for sale with a Buy Now price. If a Buy Now item remains unsold after 8 weeks, the price must be adjusted before a new sale. You may be asked to collect your item within 8 days unless otherwise agreed. If the item is not collected, you must pay a storage fee of DKK 200 / EUR 27 per week. After a further 3 weeks, we can dispose of the item or sell it in our name to cover our costs.
VAT etc. You are responsible for the correct handling of matters concerning taxes, VAT, customs and duties. As a private seller of second-hand items you are normally covered by the margin scheme for second-hand goods and so do not need to be VAT registered. If you are a professional seller, shop or producer and you sell new and unused items under the normal VAT rules, to be able to sell with us you need to be VAT registered in the country where the item is being sold. If you wish to sell second-hand items for which you reclaimed the VAT at the time they were purchased, these must also be sold with VAT. Before you start selling, you need to have entered your VAT number under 'My page' – 'Personal details' on www.lauritz.com. For items sold under the margin scheme for second-hand goods, VAT is calculated based only on the commissions and fees. For items sold under the normal VAT rules, VAT is calculated based on the hammer price/sales price, commissions/premium's and fees. Regardless of which VAT rules an item is sold under, you are paid the full hammer price minus commission and fees. You are responsible for giving correct information about the good or service so we can determine which VAT rules the good or service must be sold under.
Bids and starting bids Bids are visible, but bidders are anonymous. Everything is sold at the highest bid irrespective of the estimate. You can suggest a starting bid on consignment. It is up to the auction house, in accordance with our general guidelines, to decide whether a starting bid can/should be used for a good or service. At Lauritz.com, no starting bid is offered in the price range DKK 0-2,000 / EUR 170 (a few sales excepted). If a starting bid of DKK 2,000 / EUR 170 or less is desired, you can sell at a fixed price (Buy now). As a seller you may not bid on your own lots. We reserve the right to delete bids if we consider the bidding not to be in accordance with our guidelines.
Buy now You can agree to a fixed price for your item when you hand it in. The auction house determines the Buy Now price.
Interrupting an auction and disclaimer of liability for technical problems If the auction/sale has started the good or service cannot be withdrawn. However, we reserve the right to withdraw a good or service from auction/sale, prolong an auction/sale, or restart an auction/sale, if we consider it to be appropriate, for instance, due to suspicion of interference, error, technical difficulties or well-founded doubt about property rights. We are not responsible for delays, disruptions or technical/internet problems of any description, even if these are due to Lauritz.com's computers or technical conditions.
Faults and complaints The Danish Sale of Goods Act applies. As we are solely the commission agent and/or intermediary, it is ultimately you who have to honour all compensation and claims under consumer law. If the buyer makes a claim against us, we can withhold the item or your payment. If the buyer makes a claim after you have received your payment, at our request us you are required to pay portion of the payment that is necessary to cover the buyer's claim. If this claim exceeds the amount of the payment you received, you must also pay us the remaining balance. If the sale is executed as a part of your business activities, you bear the full responsibility for the buyer's claims, including compensation claims, unless the claims can solely be attributed to wrongful behaviour on the part of Lauritz.com. The same applies to product liability. You are additionally obliged to refund expenses we may have incurred in retrieving the item in connection with the buyer's annulment of the purchase.
Legal title You guarantee that you hold the absolute right of property to the items submitted and that these are free from third-party rights and claims. You can only consign items in your own name or with written authorization from the owner. On consignment, we register the seller's name and address. You provide Lauritz.com authority to collect necessary permissions that may be required in connection with the sale under relevant legislation.
Insurance The Danish Insurance Contracts Act applies in case of fire, theft, or water damage etc. to a lot in our care. This means that cover has to be provided by your home insurance or insurance of goods policy if items held by a third party are covered. If this is not the case, the item is normally insured by us. Compensation amounts to a maximum of the estimate with commission and hammer fee deducted. However, if at the time of the damage the highest bid or hammer price for the lot is higher than the estimate this may be taken into account in setting the level of compensation. If the lot is subject to the normal VAT rules, potential compensation may be set equalling the lot's cost price, though not exceeding 50% of the lot's estimated retail price.
Your personal details As a customer of Lauritz.com, it is important, and it is your own responsibility, to ensure that your personal information is correct and complete, including your email address and your bank account details. You can always make any necessary corrections on 'My page' – 'Personal details'. Read more about how we store and protect your personal information in our privacy policy. Lauritz.com cooperates with the police. Therefore, Lauritz.com supplies customer information to the police to the extent necessary to assist the police in their enquiries.
Amendments to the conditions We reserve the right at any time to make additions or alterations to the conditions of sale. You will be informed about any changes the next time you log in to www.lauritz.com, at which time you will be asked to accept the changes before you continue.
Choice of law and disputes Unless otherwise specified by the law, which cannot be derogated from by contract, disputes between Lauritz.com and the seller are subject to Danish law and are to be settled by the City Court of Copenhagen according to the Danish Administration of Justice Act, including the rules on appeal. In cases concerning consumer contracts, the rules of jurisdiction of the Danish Administration of Justice Act apply. See more on www.lauritz.com.
